RANCHI: Jharkhand Governor Syed Sibtey Razi on Saturday gave approval for prosecution of Maharashtra Navnirman Sena (MNS) chief Raj Thackeray
under Section 295(A) of the IPC for his remarks intended to hurt religious feelings of north Indians.
A case can be instituted under Section 295(A) only after formal approval by the state government. The Section deals with deliberate and malicious acts, intended to outrage religious feelings of any class by insulting its religion or religious beliefs.
The MNS chief had spewed venom against north Indians and the Chhath festival at a function in Mumbai on January 31, 2008.
Rajbhavan PRO S N Jha said the governor gave his assent to a petition pending against Thackeray. The petition had been submitted by Jamshedpur-based advocate Hameed Raza Khan through the East Singhbhum deputy commissioner.
In February 2008, Khan had filed a complaint case against Thackeray in a Jamshedpur court. On September 19, 2008, Jharkhand HC quashed proceedings against Thackeray under 295(A) since the petitioner had not got approval from the state government by then.
